    ECJ Rules Polish Constitutional Court Violated EU Law in Supremacy Dispute

    The European Court of Justice (ECJ) has ruled that the Polish Constitutional Court violated EU law with two judgments issued in 2021. The ECJ, based in Luxembourg, stated that the Polish court’s decisions challenged the fundamental principle of EU law’s supremacy over national legislation. The Polish Constitutional Court had asserted that EU law could only be applied if it aligned with the Polish constitution. These rulings originated from the context of judicial reforms implemented by Poland’s previous national-conservative PiS government, which Brussels had accused of undermining the separation of powers. According to the ECJ, Poland’s 2021 judgments questioned essential characteristics of the EU’s legal order. Since taking office in December 2023, the current EU-friendly Polish government, led by Prime Minister Tusk, has been actively working to reverse the reforms enacted by its predecessor.
