    EU Court Ruling Against Poland Sends Signal to Germany’s Constitutional Court

    The European Court of Justice (ECJ) ruled against Poland for violating fundamental EU law principles, emphasizing that EU law takes precedence over national law. Legal expert Franz Mayer from the University of Bielefeld notes that the ruling also serves as a message to Germany’s Federal Constitutional Court, highlighting ongoing tensions between the ECJ and national constitutional courts. The Polish Constitutional Tribunal refused to recognize decisions by the ECJ, citing conflict with Poland’s constitution. Similarly, Germany’s Federal Constitutional Court has previously argued that EU law cannot infringe on national constitutional identity, exemplified in its 2020 ruling concerning the European Central Bank, which defied the ECJ’s judgment. While Germany narrowly avoided EU infringement proceedings after assurances from its government, the presence of the so-called “constitutional court elephant” was felt in the ECJ’s decision against Poland. Most aspects of the judgment, including concerns about the impartiality and independence of Poland’s Constitutional Tribunal due to appointment irregularities, would likely not pose issues for Germany’s court according to Mayer.
