    European Court of Justice Rules Bavarian Family Allowance Violates EU Law

    The European Court of Justice has determined that Bavaria’s family allowance discriminates against EU migrant workers.

    In a ruling delivered in Luxembourg, the court found that the allowance, introduced in 2018, unfairly disadvantaged parents whose children reside in other EU countries by offering a reduced rate. The European Commission had challenged the policy, asserting that family benefits should not depend on the child’s place of residence. Although Bavaria abolished the allowance last year, a transitional provision remains for children born before 2025.
